Thomsen v. Tally
Jackson County MO
May 6, 1854
Description
The court issues and injunction against the sale of an enslaved man named Ellen. Ellen was given to Mary Fristoe Tally by her father, Richard Fristoe. Ellen and an infant child was seized to be sold as an asset by Jackson County sheriff, Benjamin Thomsen, in order to pay a $1200 debt Mary’s husband David Tally owed to the estate of his father Thomas Tally. The injunction was reversed because a law that protected a wife’s property from seizure was passed after the debt and marriage.
